示范条款
希望依据本规则仲裁解决未来争议的当事人，可在合同中约定以下仲裁条款：
1.“凡因本合同引起的或者与之相关的任何争议，包括合同的存在、效力、解释、履行、违反或者终止，或者因本合同引起的或者与之相关的任何非合同性争议，均应当提交西安仲裁委员会按照现行有效的《西安仲裁委员会仲裁规则》最终解决。仲裁裁决是终局的，对各方均有约束力。
仲裁地应当为……（中国西安）
仲裁员人数为……名（一名或者三名）
仲裁程序应当按照（选择语言）来进行。”
2.若争议已发生，而当事人之间未事先订立仲裁协议，但当事人希望依据《西安仲裁委员会仲裁规则》通过仲裁解决争议的，可以作以下约定：
“以下签字各方，均同意将因（各方发生争议的合同名称）引起的或者与之相关的任何争议，或者因该合同引起的或者与之相关的任何非合同性争议，提交西安仲裁委员会按照其仲裁规则最终解决。仲裁裁决是终局的，对各方均有约束力。
仲裁地应当为……（中国西安）
仲裁员人数为……（一名或者三名）
仲裁程序应当按照（选择语言）来进行。”

Model Clause
“We, the undersigned, agree to refer to the XAAC under the Rules any dispute arising from or in relation to (name of the contract in dispute between the parties), or any non-contractual dispute arising from or in relation to the contract. The arbitral award is final and binding upon the parties.The following clause in the contract may be agreed by the parties who wish to refer any future dispute to arbitration in accordance with the Rules:
(1) “Any dispute arising from or in relation to this contract, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising from or in relation to it shall be referred to and finally resolved by the Xi’an Arbitration Commission (“XAAC”) under the Rules in force. The arbitral award is final and binding upon the parties.
The seat of arbitration shall be ... (Xi’an, China).
The number of arbitrators is ... (1 or 3). The arbitral proceedings shall be conducted in ... (select a language). ”
(2) Where an existing dispute without a previous agreement with respect to arbitration exists, the parties who wish to refer such dispute to arbitration under the Rules may agree to do so in the following terms:
“We, the undersigned, agree to refer to the XAAC under the Rules any dispute arising from or in relation to (name of the contract in dispute between the parties), or any non-contractual dispute arising from or in relation to the contract. The arbitral award is final and binding upon the parties.
